AMIA responded to the House Committee on Energy and Commerce's Request for Information (RFI) on data privacy and security framework. The comment letter emphasized the need for a comprehensive data privacy and security law that includes clear definitions of personal and sensitive personal information. AMIA advocated for transparency in data collection, processing, and transfer, ensuring consumers are informed about the types of data collected, its purposes, and third-party transfers. We highlighted consumer rights to access, correct, delete, and object to data processing, and stressed the importance of explicit consent and enhanced security for sensitive information. Additionally, we addressed the impact of AI on data privacy, urging for responsible AI use aligned with AMIA Public Policy Principles. The response underscored the need for ethical considerations, bias control, and performance monitoring in AI-enabled devices.
